The stages, and how long each one takes
Free call and documents
Usually a few days. We confirm eligibility, quote a fixed fee and collect the documents on a simple checklist.
Drafting and filing
About one to two weeks. We draft the joint petition and settlement terms, you both sign, and we file in the right Family Court.
First motion
On the first hearing date the court records your statements. The court may refer you for a short counselling session.
Waiting period
Six months by law, unless the court waives it. Where your case qualifies we apply for the waiver alongside the petition.
Second motion and decree
You both confirm your consent again and the court grants the decree of divorce. We collect certified copies for you.
Realistic timelines
- With a waiver of the waiting period: often a matter of weeks after filing, depending on the court
- Without a waiver: around six to seven months from filing
- Couples abroad: similar, provided documents are attested at the consulate in good time and the court allows video appearance
These are typical ranges, not promises. Every court sets its own dates, and we will give you an honest estimate for your court on the first call.

Frequently asked questions
What is the fastest a mutual divorce can happen in Kerala?
If the court waives the six-month waiting period, the second motion can be heard soon after the first, and the decree can follow within weeks of filing. How fast depends on the court's list and on everything being ready.
When can the six-month waiting period be waived?
Courts look at whether you have already lived apart for a long time, whether all terms are settled, and whether there is any chance of reconciliation. Kerala courts have taken a practical approach to waiver where the marriage has clearly ended.
What if the waiting period is not waived?
Then the second motion is filed after six months, and in any case within eighteen months of the first motion. The decree is usually granted when the second motion is heard.
What slows a mutual divorce down?
Missing documents, terms that are not fully agreed, one spouse changing their mind, or difficulty attending court. We fix as much of this as possible before filing.
Do we need to live apart before filing?
Yes. At least one year under the Hindu Marriage Act and the Special Marriage Act, and two years under the Indian Divorce Act for Christian marriages.
