Questions

Frequently asked questions

What is a mutual consent divorce?

It is a divorce where husband and wife agree to end the marriage and jointly ask the Family Court to dissolve it. Because nothing is contested, there is no trial, no evidence and no cross-examination. The court only needs to be satisfied that both of you genuinely agree.

How long does it take in Kerala?

The law provides a waiting period of six months between the first and second motion. Courts in Kerala can waive this waiting period where the marriage has clearly broken down and the terms are settled, in which case it can be done much faster. We tell you which route applies to you on the first call.

Do we have to go to court?

Usually one or both of you need to appear before the Family Court at least once, either in person or, where the court allows it, by video. Many Kerala Family Courts accept video appearance, especially for couples living abroad. We arrange everything around that so you spend as little time in court as possible.

We live in different places. Is that a problem?

No. One of you can be in Kerala and the other in another state or abroad. The petition is filed in the Family Court where the marriage took place, where you last lived together, or where the wife lives, so there is usually a convenient option.

What do we need to agree on first?

Ideally the main terms: alimony or a one-time settlement, return of gold and belongings, custody and visitation if you have children, and any property. If some of this is still being discussed, we can help you put it into writing.

What documents are needed?

Marriage certificate or proof of marriage, address and ID proof for both of you, recent photographs, and any proof of living separately. If you have children or a settlement amount, those details go into the petition too. We send you a simple checklist.

What does it cost?

A fixed fee quoted after a short call, covering drafting, filing and appearances. There is no hourly billing and no surprise charges. Court fees are small and included in the quote.

Is this confidential?

Yes. Your enquiry, documents and case details are only seen by the people working on your matter. Family Court proceedings in India are not open to the public.
